By Jem Studio LLC – Terms of Service
1. Booking & Payment.
A signed contract and any required retainer/session fee are required to reserve a session date and time. Session dates are not guaranteed until payment has been received and confirmed.All remaining balances must be paid no later than 24 hours prior to the scheduled session unless otherwise agreed upon in writing.Failure to submit payment by the due date may result in cancellation of the session.
2. Cancellation & Rescheduling
Clients may reschedule a session with at least 48 hours' notice.Retainers and session fees are non-refundable but may be transferred to a future session within 90 days of the original booking date.By Jem Studio reserves the right to reschedule due to weather, illness, emergencies, unsafe conditions, or circumstances beyond reasonable control.No-shows or cancellations made within 24 hours of the scheduled session may forfeit any payments made.
3. Weather Policy
Outdoor sessions are subject to weather conditions.If weather conditions are determined to negatively impact image quality or client safety, By Jem Studio may recommend rescheduling at no additional charge.The photographer retains sole discretion regarding weather-related postponements.
4. Session Expectations
Clients are expected to arrive on time and prepared for their scheduled session.Late arrivals may result in reduced shooting time to avoid impacting other scheduled clients.By Jem Studio cannot guarantee specific poses, expressions, cooperation of children, animals, or weather conditions but will make every reasonable effort to capture a beautiful and diverse gallery.
5. Image Delivery
Edited images will be delivered via an online gallery within approximately 7–10 business days following the session unless otherwise communicated.Delivery timelines may vary during peak seasons, holidays, or unforeseen circumstances.Raw, unedited images are not included and will not be provided under any circumstances.
6. Artistic Style
Clients acknowledge that they have reviewed By Jem Studio's portfolio and understand the photographer's artistic style, editing approach, and creative vision.Final images are delivered according to the photographer's artistic judgment and discretion.Requests for substantial re-editing or style changes may incur additional fees.
7. Copyright & Usage
All photographs remain the intellectual property and copyright of By Jem Studio LLC.Clients receive a personal-use license allowing them to download, share, print, and display their images for personal, non-commercial purposes.Images may not be sold, altered, heavily filtered, edited, or used commercially without written permission from By Jem Studio LLC.
8. Model Release & Social Media
Unless otherwise requested in writing by the client prior to image delivery, By Jem Studio LLC reserves the right to use photographs for portfolio display, website content, social media, marketing materials, advertising, contests, and promotional purposes.
Clients may request privacy and opt out of public image use at any time before gallery delivery by providing written notice.
Image Use Authorization

9. Studio Sessions
Clients are responsible for adhering to all studio rules, policies, and property requirements established by the studio venue.Any damages caused by a client or their guests may be the responsibility of the client.Studio rental fees are separate from photography services unless otherwise specified.
10. Limitation of Liability
In the unlikely event of equipment failure, illness, emergency, natural disaster, acts of God, or other circumstances beyond the photographer's control, liability shall be limited to a refund of monies paid.By Jem Studio LLC shall not be liable for missed images due to lateness, non-cooperation, venue restrictions, weather conditions, or circumstances beyond reasonable control.
11. Safety
The safety of clients, guests, animals, and the photographer is the highest priority.By Jem Studio LLC reserves the right to end a session immediately if conditions are deemed unsafe, threatening, or inappropriate without refund.
12. Digital File Backup
Clients are encouraged to download and save their images promptly after gallery delivery.By Jem Studio LLC will make reasonable efforts to maintain image backups but does not guarantee indefinite storage of digital files.
13. Acceptance
By booking photography services with By Jem Studio LLC, the client acknowledges that they have read, understood, and agreed to these Terms of Service.
14. Child & Family Session Policy
By Jem Studio LLC strives to create a relaxed and enjoyable experience for children and families. However, the photographer cannot guarantee specific poses, smiles, expressions, cooperation levels, or participation from infants and children.Parents and guardians remain responsible for supervising their children at all times during the session.Clients understand that successful family photography often depends on the child's mood, energy level, and willingness to participate. The photographer will use age-appropriate techniques and patience to capture authentic moments, but no specific image or pose can be guaranteed.For safety reasons, children may never be left unattended during a session.
15. Boudoir Photography Privacy Policy
By Jem Studio LLC understands the personal and intimate nature of boudoir photography and is committed to maintaining client privacy and comfort.All boudoir images will remain private and confidential unless the client provides explicit written permission authorizing their use for portfolio, website, social media, advertising, or promotional purposes.
Clients may choose one of the following options:
☐ Full Permission – Images may be used for marketing and portfolio purposes.
☐ Limited Permission – Only non-identifying images may be used.
☐ No Permission – Images will remain completely private.
The client's selection will be documented in the photography contract and honored by By Jem Studio LLC.Clients are encouraged to communicate any comfort levels, boundaries, image preferences, or privacy concerns before and during the session. The photographer reserves the right to decline requests that create unsafe, unlawful, or excessively explicit situations.
16. Client Conduct
By Jem Studio LLC is committed to maintaining a professional, respectful, and welcoming environment for all clients.Harassment, discrimination, inappropriate behavior, threats, intoxication, illegal activity, or conduct that creates an unsafe environment may result in immediate termination of the session without refund.The photographer reserves the right to refuse service if client behavior compromises safety, professionalism, or the ability to successfully complete the session.
17. Image Alteration Policy
To ensure the integrity of the artist's work and brand, clients agree not to apply filters, presets, excessive cropping, AI modifications, or significant edits to delivered images before posting online or sharing publicly.Minor cropping for social media formatting is permitted.When sharing images online, clients are encouraged to credit By Jem Studio LLC whenever possible.
18. Force Majeure
Neither party shall be held liable for delays, cancellations, or inability to perform due to circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, government restrictions, acts of terrorism, public health emergencies, utility outages, transportation disruptions, or other unforeseen events.In such circumstances, reasonable efforts will be made to reschedule the session at a mutually agreeable date.
